MAS IMPOSES A COMPOSITION AMOUNT OF $5,000 ON DAVID LOH KIM KANG FOR FAILING TO NOTIFY THE AUTHORITY OF HIS APPOINTMENTS AS DIRECTOR AND/OR ACQUISITION OF SUBSTANTIAL SHAREHOLDINGS

1 On 3 March 08, Mr David Loh Kim Kang ["Mr Loh"] - a Capital Market Services Representative of UOB Kay Hian Pte Ltd ["UOBKH"] - paid a composition amount of $5,000 for breaches of regulation 5 of the Securities and Futures (Licensing and Conduct of Business) Regulations (RG 10) ["SFR(LCB)"]. Mr Loh was an Executive Director of UOBKH until 19 July 2007.

2 Under regulation 5 of the SFR(LCB), a Capital Market Services Representative has to notify the Authority within 14 days, of any change in his ‘Personal Particulars’ or ‘Directorship and Substantial Shareholding’ in the form prescribed in the regulation. During the period between May 2007 and February 2008, Mr Loh made late submissions to MAS on 33 occasions. These submissions, pertaining to his appointments as director and/or acquisition of substantial shareholdings in 33 companies, were late by between 4 days to 44 months.

 

Capital Market Services representatives should notify MAS of changes in their particulars in a timely manner, within the stipulated time period. This is necessary for the proper supervision of representatives by the Authority.
